You can run your own business right from the comfort of your home. Most states allow home businesses with some conditions. Please check your local county regulations. You are responsible for being compliant with these regulations and practicing safe food handling guidelines. For example, Texas Cottage Food Law allows the sale of foods that are prepared in residential homes as long as gross sales do not exceed $50,000 annually. This type of business is not regulated by a local or state health department.You do not need a permit from the local health department to start a home-based food business in Texas. The health department is prohibited from interfering with your cottage food business unless a customer files a complaint. (Texas Health & Safety Code § 437.0192.) Similar guidelines exist for non-food related home businesses.

Food Safety

To run a cottage food business, you must follow the guidelines of the state cottage food law(Texas Health & Safety Code § § 437.001 and 437.0194.), which allows you to sell food directly from your home. To operate a home-based food business in Texas, you must complete a food safety training course and obtain a food handler’s card.
